These Terms of Service ("Terms") govern your access to and use of mvrsonline.com (the "Site") and the motor vehicle record ordering and related services offered by ATDSA ("we," "us," or "our") (the "Services"). By using the Site or placing an order, you agree to these Terms. If you do not agree, do not use the Site or Services.
1. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Services. If you use the Services on behalf of a company, you represent that you have authority to bind that company to these Terms.
2. The Services
We provide access to motor vehicle records and related information obtained from state agencies and authorized data providers. We do not create or control the underlying records. Availability, content, format, and turnaround times vary by state and are outside our control.
3. Permissible Use Certification
Access to motor vehicle records is restricted by the federal Driver's Privacy Protection Act (18 U.S.C. § 2721 et seq.) and state law. Each time you place an order, you certify that:
- You have a permissible purpose under the DPPA and applicable state law for the record requested
- You will use the record only for that permissible purpose
- Where required, you have obtained the driver's written authorization and will provide it to us or a state agency on request
- You will not resell, redisclose, or share the record except as permitted by law
If you use a record for employment purposes, you are solely responsible for complying with the Fair Credit Reporting Act and any applicable state laws, including required disclosures, authorizations, and adverse action notices.
We may audit orders, request copies of authorizations, and suspend or terminate access if we believe a record was requested or used improperly. Misuse of motor vehicle records can carry civil and criminal penalties.
4. Fees and Payment
You agree to pay all fees shown at the time of order, including any state or third-party fees. Prices may change at any time without notice, but changes will not affect orders already placed. You authorize us and our payment processor to charge your selected payment method. All sales are final as described in our Refund Policy.
5. Accuracy of Records
Records are provided as received from the issuing agency or data provider. We do not verify, edit, or guarantee the accuracy, completeness, or timeliness of any record. Errors in a record must be addressed with the issuing state agency.
6. Prohibited Conduct
You agree not to:
- Request a record without a permissible purpose or required authorization
- Provide false or misleading information
- Use the Services to stalk, harass, or harm any person
- Resell or redistribute records except as permitted by law
- Interfere with, scrape, or attempt unauthorized access to the Site or its systems
- Use the Services in violation of any law or regulation
7. Intellectual Property
The Site and its content, design, and software are owned by us or our licensors and are protected by law. You may not copy, modify, or distribute any part of the Site without our written permission.
8. Disclaimer of Warranties
THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW. WE DO NOT PROVIDE LEGAL ADVICE.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA, ARISING FROM YOUR USE OF THE SITE OR SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE ORDER GIVING RISE TO THE CLAIM.
10. Indemnification
You agree to defend, indemnify, and hold harmless us and our owners, officers, employees, and agents from any claims, damages, losses, and expenses, including reasonable attorneys' fees, arising from your use of the Services, your use of any record, your violation of these Terms, or your violation of any law, including the DPPA and FCRA.
11. Governing Law and Disputes
These Terms are governed by the laws of the State of Illinois, without regard to conflict of law rules. Any dispute will be resolved exclusively in the state or federal courts located in Lake County, Illinois, and you consent to that jurisdiction. You agree to bring claims only in your individual capacity and not as part of any class or representative action, to the extent permitted by law.
12. Termination
We may suspend or terminate your access at any time for any reason, including suspected misuse. Sections that by their nature should survive termination will survive, including Permissible Use, Fees, Disclaimers, Limitation of Liability, Indemnification, and Governing Law.
13. Changes to These Terms
We may update these Terms at any time. Changes are effective when posted with a revised Effective Date. Continued use of the Site or Services means you accept the updated Terms.
14. General
These Terms, together with our Privacy Policy and Refund Policy, are the entire agreement between you and us regarding the Services. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver.
